1. Who we are, and how these terms fit together

404 Human Found is a brand and service of 404HumanFound LLC ("404 Human Found," "we," "us"), Rochester, Michigan, United States. We are part of the QUONtech ecosystem. Our parent and operating entity, QUONtech LLC, publishes its own Terms of Use and Privacy Policy that govern the QUONtech websites and the QUONlab customer portal. Where you use the QUONlab portal, those documents and your client agreement apply to that use. If you and we sign a written service agreement or order, that agreement controls over these terms wherever they conflict.

By accessing our website or using our services, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the website or the services.

2. What we provide

We design, build, and operate AI workers: AI-assisted software that supports a business's real communication work across channels such as phone, web chat, WhatsApp, and SMS. AI workers answer, book, capture, follow up, and hand work to people, with human oversight retained for decisions that require judgment. We currently serve businesses based in the United States only.

3. Human oversight and the limits of AI

AI workers assist with routine, repeatable tasks and prepare work for people to review. They can produce errors or incomplete results. They are not a substitute for professional judgment, and they do not provide legal, medical, financial, or other licensed advice. You are responsible for defining where a human must review or approve, and for that human review actually taking place. We do not guarantee any specific business outcome, response, or result produced by an AI worker.

The website also offers AI-assisted features for visitors, such as scripted demonstrations, the audition, and chat assistants. These features are provided for information and evaluation. They can be wrong, and they create no advisory relationship. Do not enter sensitive personal information, credentials, or confidential third-party data into any chat or AI feature on the website.

4. Accounts and the QUONlab portal

Ordering and managing services runs through your account in the QUONlab customer portal. We review and approve accounts by hand before activation. You agree to provide accurate information, not to impersonate anyone, and to keep your credentials confidential. You are responsible for activity under your account and for the users you authorize. Use of the portal is additionally governed by the QUONtech Terms of Use and your client agreement, and data you place in your portal tenant is isolated to your organization.

5. Orders, fees, and billing

Plans and fees are described on our pricing page. Starter and Professional plans include a one-time setup fee in addition to the monthly fee. Bespoke and on-premise engagements are scoped and quoted individually, with no standard setup fee. Submitting a request through our website is not a binding order; we confirm scope, fees, and terms with you before any service goes live, and no payment is taken on the website forms.

Monthly plans renew monthly and can be cancelled at any time, effective at the end of the current billing period. Setup fees cover workflow design, build, and launch and are earned when the build is delivered. Fees are otherwise non-refundable except where required by law or expressly agreed in writing.

6. Your responsibilities and required notices

You agree to provide accurate information, to use the services lawfully, and not to use them to harass, deceive, or harm others, to violate any law, or to handle data you are not permitted to handle. You are responsible for the content, knowledge, and instructions you provide to your AI worker and for any approvals your workflows require.

Communication laws differ by state and industry, and you are responsible for the notices and consents your use of the services requires. This includes, where applicable, telling callers and message senders that they are interacting with an AI system, obtaining any consent required for call recording, monitoring, or transcription in the states where your customers are located, honoring do-not-call and messaging opt-out rules, and complying with any rules specific to your industry. Do not route data that is subject to a special legal regime, such as protected health information, through the services unless a written agreement covering that data is in place.

7. Conversation data

"Conversation Data" means the recordings, transcripts, messages, summaries, and related metadata generated when your AI worker interacts with your customers and contacts. As between you and us, Conversation Data is yours. We process it only to provide, secure, and support the services for you, under your instructions and your agreement with us. Transcripts are retained for twelve months by default, and you can export or delete your Conversation Data at any time from your portal. We do not sell Conversation Data. Our Privacy Policy describes this processing in more detail.

8. Acceptable use

You agree that you will not: use the website or services for any unlawful purpose; damage, disable, overburden, or impair them, or interfere with anyone else's use; send automated requests beyond what a person could reasonably generate, or use scrapers or bots to circumvent how the website is intended to be used; decompile, reverse engineer, or attempt to derive source code from the services, except where that restriction is prohibited by law; access areas or accounts you are not authorized to access; upload or transmit malicious code; collect information about other visitors without their consent; or present an AI worker as a human being in circumstances where disclosure is required.

9. Text messaging terms

If you opt in to text messages from 404HumanFound LLC, you agree to receive account and service messages at the mobile number you provide, such as confirmations, reminders, and account notifications. Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to opt out at any time; after you send STOP, you will receive one confirmation message and no further texts unless you opt in again. Consent to receive text messages is not a condition of purchasing any product or service. Carriers are not liable for delayed or undelivered messages.

10. Intellectual property

We and our licensors retain all rights to our software, methods, designs, documentation, and materials, and to the 404 Human Found name, logo, and marks. Marks of the wider QUONtech ecosystem, including QUONtech, QUONlab, and QUONCRM, are owned by their respective entities. You may not use our marks without prior written consent. You retain all rights to your own content and data. We grant you a limited, non-exclusive, non-transferable right to use the services during your engagement, and you grant us the rights necessary to operate the services for you.

11. Third-party services and links

The services rely on third-party infrastructure and tools, and the website may link to third-party sites we do not control. We are not responsible for the content, products, or privacy practices of third parties, and your use of their sites and services is subject to their terms.

12. Disclaimers

THE WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT OR OUTPUT IS ACCURATE, COMPLETE, OR CURRENT.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, 404HUMANFOUND LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE WEBSITE, THE SERVICES, OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

14. Indemnification

You agree to indemnify and hold 404HumanFound LLC harmless from any claim, loss, or expense, including reasonable attorneys' fees, arising from your use of the website or services, the content and instructions you provide, your failure to give notices or obtain consents required for your use, your breach of these terms, or your violation of any law or third-party right. We may assume the exclusive defense of any matter subject to indemnification, and you will cooperate.

15. Suspension and termination

Either party may end an engagement as described in the applicable order or agreement. We may suspend or terminate access to the website or services if these terms are violated, if we have reason to suspect a security issue, or if required to protect the services, our customers, or others.

16. Governing law and disputes

These terms are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-laws rules. The exclusive venue for disputes is the state and federal courts located in Michigan, and you consent to their jurisdiction. Any claim must be brought within one year after it arises, or it is permanently barred, except where a longer period is required by law.

17. Changes

We may update these terms from time to time. Material changes will be posted here with an updated effective date. Continued use after changes means you accept them.

18. Miscellaneous

These terms do not create a partnership, joint venture, employment, or agency relationship. Our failure to enforce any provision is not a waiver. If any provision is found unenforceable, the rest remain in effect. You may not assign these terms without our written consent; we may assign them within the QUONtech ecosystem or in connection with a business transfer. These terms, together with the Privacy Policy and any separate written agreement, are the entire agreement between you and us regarding the website and services.
